I. GENERAL PART

  1. “Gradiali pool and sauna area” (hereinafter referred to as the “Pool”) is a recreational water
    space with swimming pools and saunas, located in Vanagupės str. 15, Palanga.
  2. The operator of the Pool (hereinafter referred to as the “Operator”) – “Sveikatos uostas”,
    UAB (reg. address Vanagupės str. 15, Palanga, company code 303997416, VAT identification
    number LT100009311612).
  3. Visitor – any person who has purchased a ticket, membership or other lawful means of
    access to the Pool, as determined by the Operator.
  4. The Internal Rules of the Pool and Sauna Area (hereinafter referred to as the “Rules”)
    establish the procedure for the sale, purchase, exchange and return of tickets,
    memberships, additional services, the rights, duties and responsibilities of the Operator
    and the visitor, as well as the general requirements for safe behaviour, hygiene and other
    requirements for visitors.
  5. The Rules may be amended at the Operator’s sole discretion at any time, without prior
    notice. The latest and up-to-date version of the Rules is available to visitors on the website
    www.gradiali.lt and at the Pool front desk.
  6. The Rules of the Pool are designed to ensure the safety of every visitor, to ensure a pleasant
    stay and good mood in the facility, and to avoid any unpleasant misunderstandings, injuries
    or losses.
  7. These Rules are binding on all visitors to the Pool, regardless of age. It is the responsibility
    of the individual to read these Rules before acquiring services and to abide by them when
    using the Pool.
  8. By acquiring the Pool services, each person automatically confirms that he/she is aware of
    these Rules and undertakes to comply with them unconditionally. The Rules of the Pool are
    drawn up in accordance with the legislation of the Republic of Lithuania and are published
    at the place of provision of services and on the Operator’s website www.gradiali.lt. The
    visitor shall be solely responsible for the consequences resulting from ignorance of or
    failure to comply with these Rules. The Pool staff reserves the right to refuse to allow entry
    or to ask to leave visitors who do not comply with these Rules.
  9. Persons of all ages are entitled to use the services provided within the Pool, with the
    possible exceptions set out in these Rules.
  10. In order to ensure hygiene and the safety of visitors, it is prohibited to visit the Pool for:
    10.1. persons with infectious upper respiratory tract diseases, viral diseases (e.g. influenza,
    Covid-19), other respiratory infections (e.g. tuberculosis);
    10.2. persons suffering from infectious diseases of the skin, nails, hair, eyes (including
    fungal infections, etc.);
    10.3. persons suffering from infectious diseases of the skin, nails, hair, eyes (including
    fungal infections, etc.);
    10.4. persons suffering from incontinence, unless they are wearing special bathing trunks
    during the visit;
    10.5. persons suffering from intestinal infections (e.g. rotavirus);
    10.6. persons with open wounds;
    10.7. persons with other medical conditions that pose a threat to their own or other visitors’
    health and safety, or suffering from other contagious diseases;
    10.8. persons under the influence of alcohol, drugs or psychotropic substances. The Pool
    staff has the right to ask a visitor to take a sobriety test;
    10.9. persons who do not have a smart wristband (except for children under 6 years of age
    (inclusive), no wristbands are issued);
    10.10. persons whose behaviour endangers the Pool’s visitors, staff, the Pool’s inventory,
    equipment, infrastructure and their safety and hygiene or contravenes the socially
    accepted rules of appropriate behaviour.
  11. Children under 18 years of age must be accompanied by an adult who is responsible for
    their safety. The adult must be over 18 years of age and must take full responsibility for the
    safety, health and behaviour of the children under his/her supervision, for informing the
    children of these Rules and for ensuring that they comply with them and that the lockers for
    the storage of the children’s belongings are locked securely.
  12. Group leaders – or persons in charge – of groups of children under the age of 18 are fully
    responsible for ensuring that group members comply with the Rules and the instructions of
    the staff.
  13. Persons with disabilities who, due to their disability, require the supervision of another
    person may only visit the Pool when accompanied by an adult supervising them. The 18+
    lounge area of the Pool is not accessible for wheelchair users.
  14. The Pool or part of it may be temporarily closed for maintenance work, with prior notice on
    www.gradiali.lt.
  15. Saunas, swimming pools and hot tubs are switched off 10 minutes before the closing time
    of the Pool. Visitors must leave the Pool through the exit gates before the end of the Pool’s
    official opening hours or immediately after being instructed to do so by staff.

Procedure for purchasing tickets and memberships

  1. The prices of tickets to the Pool shall be determined by the Operator. Ticket prices are
    available at the Pool front desk and on the website www.gradiali.lt.
  2. Tickets can be purchased at the front desk of the Pool, online at www.gradiali.lt and on the
    websites of the Operator’s official partners.
  3. Named memberships are available at the front desk of the Pool, online at www.gradiali.lt
    and on the websites of the Operator’s official partners.
  4. Upon request of the staff, the person/visitor is obliged to present his/her identity document
    for the purpose of identification and/or age verification. If the person/visitor refuses to
    provide proof of identity, services are not provided.
  5. Tickets are not sold 90 minutes before the Pool closes. The sale of tickets may be
    suspended (e.g. in case of technical difficulties; when all lockers are occupied; due to a
    limited number of spaces in order to ensure the comfort of the visitors during their visit;
    other important reasons).
  6. No refunds will be given to any person who has purchased a ticket, membership or gift
    voucher and chooses not to use the Pool services.
  7. A person who has purchased a ticket or membership to the Pool may not exchange it for
    other services or visit at other times.
  8. Due to technical difficulties, during major events, or for other important reasons, access to
    certain services may be temporarily denied in the Pool: jacuzzis, swimming pools, saunas,
    etc. In this case, the ticket price will not be recalculated and no refund will be given to the
    Visitor.
  9. Anyone wishing to purchase a discounted ticket must present a document entitling them to
    the discount.
  10. If a Visitor wishes to re-enter the Pool area after leaving the Pool, he/she must purchase a
    new ticket.
  11. For breaches of these Rules, the Pool staff shall have the right to cancel the validity of the
    membership.

Smart wristband, its purpose and use

  1. A smart wristband is issued at the front desk of the Pool and is assigned to each visitor
    individually.
  2. After receiving the smart wristband, guests must enter the Pool entrance gate within 15
    minutes and activate the smart wristband. If the smart wristband is not activated within 15
    minutes, it will be automatically blocked and no refund will be issued.
    29.Upon receipt of the smart wristband, a credit is granted, which can be used to purchase
    additional services in the Pool (at the Pool café, etc.):
    29.1. for children under 6 years of age (inclusive) no credit is granted;
    29.2. for children aged 7-17 years, the credit amounts to EUR 25;
    29.3. for adults, the credit amounts to EUR 200.
  3. Guests of Gradiali Hotel can obtain smart wristbands at the front desk of the Pool upon
    presentation of their room key card.
  4. If the credit limit is exhausted and the visitor wishes to reinstate it, he/she must pay his/her
    bill in cash or by credit card at the front desk of the Pool. If the credit limit is exhausted and
    the guest wishes to reinstate it, the payment can be charged to the room account.
  5. Persons who receive smart wristbands must enter through the entrance gates one at a time
    by placing the wristband on the reader located on the gate. The time spent in the Pool shall
    be counted from the moment the visitor enters through the entrance gate and shall stop
    when the visitor leaves through the exit gate.
  6. With a smart wristband, visitors to the Pool area can:
    33.1. unlock and lock the storage locker;
    33.2. make purchases at the Pool café;
    33.3. rent a towel in the Pool café;
    33.4. see details of their ticket type, locker number and length of stay on the infoterminal.
  7. Any visitor who loses their smart wristband or damages the electronic part of the smart
    wristband must inform the Pool staff immediately. A fixed fee will be charged for the loss or
    damage of the smart wristband.
  8. Before leaving the Pool, the visitor must pay at the front desk of the Pool. Hotel guests are
    given the option of having the payment added to their room bill. The visitor shall be shown
    the time spent in the Pool and the amount due for the services provided and/or goods
    purchased in the Pool.
  9. The visitor may not leave the Pool area without paying for the services provided and/or goods
    purchased in the Pool (Gradiali Hotel guest services and/or goods purchased may be
    credited to the room bill).
  10. The provisions of Clause 36 of these Rules shall not apply if a visitor is forced to leave the
    Pool through a special exit (e.g. in the event of an evacuation or other unforeseen
    circumstances). In this case, the smart wristband shall be handed over to the Pool staff.
  11. In case of early exit, i.e. not having stayed for the full allotted time limit, the visitor will not
    be refunded for the time not spent.
  12. Exceeding the time limit (time not paid for when purchasing the ticket) or leaving past the
    Pool’s official opening hours will be settled as follows:
    39.1. if a visitor exceeds the ticket time limit, the fee is charged for the additional time spent
    from the first minute in 30-minute intervals;
    39.2. The fee shall be calculated according to the rates in force at the time and shall be
    payable at the front desk of the Pool. The fee shall be included in the hotel guest’s
    room bill.

Other general information

  1. Opening hours of the Pool: weekends and weekdays from 08:00 to 22:00. Opening hours are
    also indicated at the entrance to the Pool and on the website www.gradiali.lt.
  2. The Pool is monitored by CCTV cameras for the safety of the public. Video surveillance data
    is processed in accordance with the Operator’s Privacy Policy, which is available on the
    Operator’s website www.gradiali.lt/privatumo-politika/.
  3. Smoking, the use of electronic cigarettes or the use of combustible tobacco products in the
    territory of the Pool is prohibited.
  4. Visitors must only change clothes in specially equipped changing rooms. They must lock
    their clothes and outdoor footwear in a locker. We recommend that mobile phones be left
    in the locker on silent mode. The Operator is not responsible for the safety of items left in
    the lockers.
  5. The red indicator on the lock housing lights up when the locker is locked, and the red
    indicator on the lock housing becomes inactive when the locker is unlocked. Visitors must
    carefully check that the locker is securely locked. Instructions for the use of the lockers are
    displayed on the locker doors.
  6. Each visitor is entitled to use no more than one storage locker. Attempts to use more than
    one locker shall be considered as breaking into a locker that is not their own.
  7. In case of any doubts regarding the use of the services provided at the Pool, please contact
    the Pool staff.
  8. Alcoholic beverages are not sold in the Pool café to visitors under 20 years of age and energy
    drinks to visitors under 18 years of age.
  9. Visitors must wear slippers suitable for use in wet environments and when walking on wet
    surfaces.
  10. The sauna area is intended for relaxation and recreation and therefore guests must be quiet
    and respect other visitors’ space.
  11. It is mandatory to wear swimwear in the entire Pool area (including the saunas, but
    excluding the changing rooms).
  12. Visitors must leave the Pool immediately if requested to do so by the Pool staff (e.g. in case
    of evacuation).
  13. Children under 18 years of age must not be left alone in the Pool area without adult
    supervision.

II. RESPONSIBILITIES OF VISITORS

Lankytojas įsipareigoja:

  1. The visitor undertakes:
    53.1. to make sure that his/her health condition allows him/her to use the specific services
    provided at the Pool before he/she starts to use them. Persons with medical
    conditions or exceptional medical conditions (e.g. heart disease, pregnancy, etc.)
    should consult a doctor before accessing the saunas or the swimming pools. The
    negative consequences of not following this advice are the responsibility of the visitor;
    53.2. to comply with the requirements and guidelines set out in the Rules and to observe
    any information and safety notices or signs displayed in the swimming pool and sauna
    areas while in the Pool and using the services provided therein;
    53.3. to wear and use only his/her assigned smart wristband while in the Pool;
    53.4. to comply with the instructions of the staff regarding safety requirements and the
    observance of these Rules in the Pool;
    53.5. to comply with any special requirements related to the decisions of the Government
    of the Republic of Lithuania or other authorities (e.g. quarantine);
    53.6. in the event of illness or any health problems, visitors must assess their state of health
    and whether they can continue their stay at the Pool.

III. RIGHTS AND OBLIGATIONS OF THE OPERATOR

  1. The Operator shall have the right:
    54.1. to refuse entry to the Pool without further explanation to persons whose behaviour
    may disturb the rules of the Pool, endanger the safety and health of other visitors, the
    hygienic condition of the Pool, and/or contravene socially accepted norms of
    behaviour;
    54.2. to exclude persons from the Pool if they do not agree to abide by or do not understand
    these Rules after explanation given at the front desk or the staff of the Pool;
    54.3. to change the list of services and/or the rates of the Pool without prior notice;
    54.4. to exclude from the Pool visitors who violate the Rules of the Pool, disregard the
    warning signs posted in the territory of the Pool, do not comply with the instructions
    of the staff, do not behave in accordance with the norms of socially accepted
    behaviour. In this case, no refunds will be given to visitors;
    54.5. to organise private evenings in the Pool or in a separate part of the Pool;
    54.6. to hold concerts or performances during which the requirements of Clause 49 are
    temporarily not complied with. Information about events shall be made available in
    advance on the website www.gradiali.lt.
  2. The Operator undertakes to provide services to visitors in the Pool in accordance with the
    requirements of the relevant normative legal acts of the Republic of Lithuania and the
    provisions of these Rules.

IV. RECOMMENDATIONS FOR VISITORS

  1. The Pool management recommends that visitors planning to use the Pool assess their
    physical abilities and health (e.g. chronic illnesses, injuries, pregnancy, etc.), as the Pool’s
    activities involve the use of physical strength and vigour. Due to the variety of activities
    available in the Pool, as well as the physical or mental condition of individual visitors,
    certain activities may not be recommended by doctors. Visitors are advised to have their
    health checked by their personal health care professionals before visiting the Pool
  2. Outerwear (e.g. jackets, coats) should be left in wardrobes during the cold season.
  3. Visitors wearing glasses may leave them in the special unsecured shelves when using the
    services of the Pool.
  4. It is not recommended to bring expensive and valuable items (jewellery, chains, rings,
    watches, mobile phones, etc.) to the Pool, which may be damaged by moisture or lost. The
    Operator shall not be liable for lost or damaged items.

V. GENERAL RULES OF THE POOL AND SAUNA AREA

  1. The large swimming pool and vertical bath offer exercise and other wellness treatments.
    Visitors taking part in these activities must follow the instructions of the staff.
  2. Children under 3 years old must wear special nappies suitable for immersion in water.
  3. Before entering or leaving the Pool area, and before entering and using the pools, saunas
    and baths, guests must take a shower.
  4. Access to the dry saunas is only possible with a towel, which must be spread out on the
    wooden loungers under the whole body in the sauna.
  5. A towel must be spread on the chairs and loungers.
  6. The bench must be rinsed with water upon entering and before leaving the steam room.
  7. It is recommended to stay in the saunas for no more than 7 minutes and no more than three
    times, with a 10-minute break. Visitors with cardiovascular diseases are also
    recommended to assess their ability to use the sauna.

VI. PROHIBITIONS

67. In the Pool area, it is prohibited to:

67.1. bring glass, breakable and sharp objects;
67.2. pack food and drink;
67.3. carry/spill drinks and food in saunas, pools and hot tubs;
67.4. create dangerous situations for themselves and other visitors;
67.5. bring pets;
67.6. damage the equipment in the Pool;
67.7. shout, whistle, falsely call for help, run around;
67.8. use the Pool services wearing inappropriate clothing (e.g. underwear, outer
clothing);
67.9. spit on the floor and in the water;
67.10. leave children under 18 unsupervised;
67.11. consume alcoholic beverages for persons under 20 and energy drinks for persons
under 18;
67.12. smoke (including electronic cigarettes or combustible tobacco) in places other than
designated smoking areas;
67.13. wear outdoor footwear, except in the area before the changing rooms;
67.14. wear footwear other than for swimming and clothing other than for immersion in
water;
67.15. jostle, be rude, or interfere with the use of the Pool by other visitors;
67.16. use a smart wristband other than the one assigned to the visitor;
67.17. wear any type of jewellery or other items that may cause damage to themselves
and/or the Pool’s equipment when accessing the Pool;
67.18. get in or out of swimming pools in places other than designated areas;
67.19. jump into the water from the edges of pools, hot tubs, diving boards and to dive;
67.20. use floaties, inflatable mattresses and other personal water sports equipment which
is not primarily intended to protect persons from drowning;
67.21. for visitors who do not know how to swim, to be in swimming pools and hot tubs
without wearing life jackets or without inflatable armbands;
67.22. create situations that could cause harm to other Pool users;
67.23. bring their own infusions, extracts and vapours to the saunas and use them there;
67.24. pour water on the stones in the saunas;
67.25. use personal cosmetics in the saunas;
67.26. adjust the appliances in the saunas;
67.27. reserve seats on loungers and chairs. The Pool staff has the right to hang up towels
and bathrobes left on the loungers and chairs;
67.28. reserve places in the saunas. The Pool staff has the right to collect towels and
bathrobes to mark the reserved place in the baths;
67.29. be under the influence of alcohol, narcotics and psychotropic substances in the
saunas and water;
67.30. film and/or photograph other visitors, the staff of the Pool without their consent, or
publish images without their permission.

VII. RESPONSIBILITY

  1. Any visitor who causes damage to the Pool, its property, visitors’property and/or health shall
    be liable in accordance with the procedure established by the laws of the Republic of
    Lithuania. Parents and/or guardians shall be liable for damage caused by children or
    persons with disabilities.
  2. The Operator of the Pool shall not be liable:
    69.1. for visitors’ personal belongings left in changing rooms, on loungers or in other areas;
    69.2. for lost/damaged personal and rented items (towels, slippers, etc.);
    69.3. for the actions of visitors towards themselves or other visitors.
  3. Visitors who fail to pay for additional time spent or services rendered shall be liable in
    accordance with the procedure established by the laws of the Republic of Lithuania.
  4. Parents, guardians or other adults who accompany children or disabled persons are
    responsible for informing the children and disabled persons about the rules of the Pool and
    for ensuring that they comply with these Rules.
    72.Compensation for material damage:
    72.1. for lost/unreturned smart wristbands or damaged electronic part – EUR 25.
  5. A visitor who has suffered property and/or non-property damage in the Pool, who has
    complaints and/or claims against the Operator, shall immediately notify the Pool staff,
    specifying the place, time, circumstances and persons who witnessed the incident. If the
    visitor does not comply with this condition, subsequent complaints and claims shall not be
    considered.
  6. In the event that a visitor suffers property and/or non-property damage in the Pool as a result
    of the Operator’s fault, the Operator shall be liable in accordance with the procedure
    established by the laws of the Republic of Lithuania.
  7. The Operator shall not deal with the visitor’s claims and shall not be liable for any property
    and/or non-property damage suffered by the visitor at the Pool, if the visitor has not
    complied with the requirements and/or recommendations set out in the present Rules and
    the instructions, rules of use of swimming pools and saunas, available at the Pool
  8. The Operator shall not be liable for any consequences or damage to the health and property
    of visitors or to third parties, and shall not accept or investigate any claims if such
    consequences are caused by the visitors’ own negligence, non-compliance with the
    present Rules, non-observance of the information provided on warning signs and notices,
    and non-compliance with the lawful instructions of the Pool staff.
